DPP opposes bail for ex-Kiambu governor Waititu
ODPP says Waititu is serving a lawful sentence
Waititu suffered a blow after the court ordered him to remain in custody for one more month.
In Summary
Wiper leader Kalonzo Musyoka and his DAP-K counterpart Eugene Wamalwa on Wednesday sat in court during the bail hearing for former Kiambu Governor Ferdinand Waititu.
They were accompanied by advocates Ndegwa Njiru and Kibe Mungai, at the Milimani High Court, Nairobi.
The ruling on the hearing was a blow to Waititu, as the court ordered him to remain in custody for one more month.
High Court Judge Lucy Njuguna ruled that Waititu is set to stay in custody till April 23, when the court will rule on whether he can amend his appeal.
On March 18, Waititu filed an application seeking bail/bond release pending an appeal against a jail sentence.
The former Governor was sentenced to pay a fine of Sh54.5 million or, in default, serve a 12-year jail term after being convicted of graft.
This marks the second time he is applying for bail.
"The sentence is harsh and oppressive and the continued imprisonment of my client will cause a miscarriage of justice that is both unlawful and unjustified," his advocate Mungai told the court.
Waititu maintains that the charges against him were defective and that the trial court failed to take into consideration that Testimony Enterprises had other monies in its bank account and therefore money transferred to him was not 'invariably for the County Government of Kiambu'.
