In Summary








    As outlined under Article 49 of the Constitution, if you are arrested, you have the right to be told why you’re being arrested in a language you understand.

    You can remain silent and do not have to say anything until you see a lawyer or a person of your choice.

    You should appear in court within 24 hours and have the right to apply for bail or bond.


    Importantly, you cannot be held longer than necessary without being charged, and you must be treated humanely and with dignity.


    Detainees must also be kept away from convicted criminals.


    It’s your constitutional right to be presumed innocent until proven guilty, and you cannot be remanded if the offence carries a sentence of only six months or a fine.
