Court of Appeal announces August–September recess

The Court of Appeal has officially announced its 2025 recess reschedule.

According to a notice issued by Justice Daniel Musinga, the Court's President, the break in regular sittings has been scheduled for August.

It will begin on Friday, August 1, and run through to Monday, September 15, 2025, both dates inclusive.

The recess is in accordance with Article 164(1) of the Constitution of Kenya and Rule 20 of the Court of Appeal Rules, 2022.

This rule provides the legal foundation for scheduling official breaks in court sittings, while also making it mandatory for the Court to remain partially operational, especially for urgent applications.

Despite the break, the Court’s registry will, however, remain open to the public from 9 am to 12 pm on weekdays, except public holidays. 

In addition, Justice Musinga stated that a judge or judges will be on standby to handle any urgent matters that may arise during the recess period.

This annual break is not a shutdown but rather a necessary part of judicial operations. 

It gives the appellate judges dedicated time to write pending judgments and conduct legal research.

They also use it to manage internal case reviews, essential in a court that handles complex and high-stakes appeals from across the country.

It further provides space for administrative duties and judicial training, often carried out during this period through retreats and colloquia aimed at enhancing judicial effectiveness.

The Court is expected to resume normal operations immediately after the recess, with full sittings and registry hours reinstated from Tuesday, September 16, 2025.
