In a landmark ruling delivered by High Court Justice Cecilia Githua, former Migori Governor Okoth Obado, along with Michael Oyamo and Caspal Obiero, were convicted of the murder of Sharon Otieno.
Justice Githua affirmed that all legal elements and ingredients of murder were conclusively proved against the accused, establishing that the prosecution proved its case beyond a reasonable doubt.
The court highlighted that Sharon’s pregnancy underscored the gravity of the offence, adding weight to the severity of the crime committed.
The judicial findings firmly dismissed the defence arguments regarding location, determining that Obado’s geographic location did not constitute a valid defence.
Instead, the court ruled that he played an active role in planning and facilitating the killing.
Central to the judgment was the strength of the prosecution's narrative, as Justice Githua noted that the evidence presented formed an unbroken chain that linked all three accused directly to the fatal crime.
